Terms and Conditions for the Use of the LinkYourTicket Platform
Section 1: Provider, Scope, Language Versions
(1) These Terms of Use govern the relationship between the platform provider and end users in respect of the use of the mobile application (app) and the LinkYourTicket website. The provider is
Frank Arlt, 14 B Bankstraße, 47441 Moers, Germany\ <info@linkyourticket.com> +49 175 7413461
(2) These Terms of Use govern solely the legal relationship between the Provider and the user of the app and/or the website. The terms and conditions of the relevant organiser shall apply exclusively to the delivery of the booked activity. The terms and conditions of the payment service provider shall also apply to the processing of payments.
(3) Any terms and conditions of the user that differ from or supplement these shall not form part of the contract unless the provider expressly agrees to their validity in writing.
(4) These Terms of Use are provided in the languages offered within the application. The German version shall prevail, unless mandatory provisions of the law of the country in which the user, as a consumer, has their habitual residence stipulate otherwise.
Section 2: Definitions and Status of the Provider
(1) For the purposes of these Terms of Use, the following terms shall have the meanings set out below:
- Platform refers to the provider’s mobile application and website,
- Organiser means the company which carries out an activity on its own responsibility and offers it via the platform,
- Activity is a leisure service for tourists, in particular an excursion, a tour or an experience,
- Booking contract means the contract between the user and the organiser for the provision of an activity,
- User means any natural person who uses the platform,
- Consumer means a user within the meaning of Section 13 of the German Civil Code (BGB).
(2) The provider acts solely as an intermediary and is not the organiser. The booking contract is concluded solely between the user and the organiser. The provider does not become a party to the booking contract and is under no obligation to carry out the activity or to transport the user.
(3) The organiser’s identity, address, contact details and registration information are displayed to the user before the booking enquiry is submitted and in the booking confirmation. This information is accessible without a prior security check.
Section 3: Services provided by the provider
(1) The provider makes the platform available to the user and enables them to search for activities, submit booking enquiries, make payments, receive tickets, cancel bookings and process refunds.
(2) The Provider shall make available updates necessary to maintain the application’s functionality as stipulated in the contract, including security updates, and shall inform the User thereof. If the user fails to install a provided update within a reasonable period, the provider shall not be liable for defects arising solely from the absence of that update, provided that the provider has informed the user of the availability and consequences of failing to install it.
(3) Descriptions of activities are provided by the respective organiser. The provider may translate these descriptions automatically into other languages. The original version posted by the organiser shall prevail. The provider accepts no liability for the accuracy or completeness of the information provided by the organiser.
(4) The provider is under no obligation to ensure the platform is available without interruption. Maintenance work will be carried out during periods of low usage wherever possible.
Section 4: Registration, User Account
(1) The platform can be used without registering, in particular to view activities and add items to your basket. A user account is required to make a booking via the platform, as this is how tickets, cancellations and withdrawals are processed.
(2) Truthful and complete information must be provided for registration and booking purposes. The user must keep their login details confidential and must notify the provider immediately if there are any indications of unauthorised use.
(3) You must be of legal age to register and submit booking declarations.
(4) The provider may require verification of the mobile phone number provided by means of a text message.
(5) The user may delete their user account at any time without giving a reason by using the function provided for this purpose in the application’s settings. Deleting the user account does not terminate the booking contract.
Section 5: Formation of the Booking Contract, Reservation
(1) The presentation of activities on the platform does not constitute a binding offer, but rather an invitation to submit a booking enquiry.
(2) Before submitting the booking enquiry, the user is shown the key details of the activity, the date, the total price including all taxes and other charges, the organiser’s cancellation policy, and information on whether or not a right of withdrawal applies.
(3) By clicking the button indicating the payment obligation, the user makes a binding offer to the organiser to conclude the booking contract. The booking contract is concluded upon receipt of the booking confirmation, which the provider sends on behalf of the organiser.
(4) The provider may provisionally reserve places for the duration of the booking process. The reservation will automatically lapse at the end of the time limit displayed in the application if the booking process is not completed. There is no entitlement to the reservation being maintained.
Section 6: Prices, Payment, Invoicing
(1) The prices displayed at the time of booking apply. The prices are set by the organiser and are all-inclusive.
(2) Payment is processed via the payment service provider Stripe Payments Europe Limited, The One Building, 1 Lower Grand Canal Street, Dublin 2, Ireland. Card details are collected exclusively by the payment service provider and are not stored by the supplier.
(3) The organiser is entitled to the payment due under the booking contract. The payment is received by the payment service provider on behalf of the organiser and credited to the organiser’s account with that payment service provider. The provider receives from the payment solely the commission owed to it by the organiser. This does not give rise to any fee payable by the user to the provider.
(4) The organiser issues the invoice for the activity. The provider sends the user the booking confirmation, including details of the organiser’s identity, and the ticket.
Section 7: Right of withdrawal
(1) If the user is a consumer, they are entitled to a right of withdrawal in respect of distance contracts in accordance with Section 312g(1) and Section 355 of the German Civil Code (BGB), provided that no grounds for exclusion under Section 312g(2) of the German Civil Code (BGB) apply.
(2) In the case of activities for which a specific date or period has been agreed, there is no right of withdrawal under Section 312g(2)(9) of the German Civil Code (BGB). Whether this ground for exclusion applies to the activity in question will be indicated to the user in relation to that specific activity before the booking enquiry is submitted.
(3) Where a right of withdrawal applies, the user shall receive the organiser’s withdrawal policy, together with a model withdrawal form, before submitting the booking enquiry.
(4) If a right of withdrawal applies to an activity, the provider shall make a withdrawal function available within the application. It shall be labelled ‘Withdraw from contract’. The user may use this function to notify the organiser of their withdrawal and will receive confirmation of receipt. This function is provided in addition to the other options for declaring withdrawal.
(5) Once an activity has commenced, the user may revoke it – provided it does not have a specific date or timeframe – only under the conditions set out in Section 356(4) of the German Civil Code (BGB).
Section 8: Cancellation and Refunds
(1) Cancellation is free of charge up to at least 48 hours before the start of the activity.
(2) If the user cancels the booking before the end of the free cancellation period, they will receive a full refund of the amount paid. The user will not be charged any payment processing fees.
(3) If the user cancels the booking after the free cancellation period has expired, they will be refunded the amount paid, less the cancellation fee previously stated.
(4) The cancellation fee shall not exceed 50 per cent of the total price. It shall only apply in the event of cancellation within the last 48 hours before the start of the activity or after the expiry of any longer grace period granted free of charge by the organiser.
(5) Cancellation is carried out using the function provided for this purpose within the application. The refund will be processed immediately once the cancellation takes effect and will be made to the same payment method that the user used to make the payment.
(6) The user is free to prove that the organiser has suffered no loss as a result of the cancellation, or a loss that is substantially less than the cancellation fee retained. If the user proves this, the cancellation fee shall be reduced accordingly.
(7) If the organiser cancels the activity, the user shall be refunded the full amount paid. Any further claims the user may have against the organiser remain unaffected.
Section 9: Ticket, Release of the Ticket Link
(1) The ticket is provided to the user as an electronic document. It can be accessed via a non-guessable, time-limited link.
(2) The user can share the ticket using the sharing function. Anyone with the link can view the ticket, including the booking details and verification code, without having to log in. The user should therefore only share the link with people they trust.
(3) The link generated via the sharing function expires after seven days, whilst the link contained in the booking confirmation expires after one hundred and eighty days.
(4) The resale of tickets booked via the platform at a price higher than the booking price is prohibited.
Section 10: User’s Obligations
(1) The user may only use the platform for its intended purposes. In particular, the following are prohibited:
- the use of automated processes to extract content, unless expressly permitted,
- actions that compromise the availability, integrity or security of the platform,
- circumventing access and security measures,
- submitting booking enquiries without any intention of booking,
- the removal of unlawful, offensive or untrue content.
(2) The user must provide accurate details necessary for the activity to take place, in particular their name, contact details and, where a collection service forms part of the activity, the collection point.
(3) The user must comply with the safety and participation requirements set out by the organiser.
Section 11: User Content
(1) If the user uploads content, in particular reviews or images, they warrant that they hold the necessary rights and do not infringe the rights of any third parties.
(2) The user grants the provider a non-exclusive, geographically unrestricted and royalty-free right to reproduce, store, translate and make this content publicly available in the context of the operation and promotion of the platform. The right of use shall cease upon the deletion of the content by the user, unless further use is necessary to fulfil statutory obligations.
Section 12: Valuations
(1) Reviews may only be submitted if the user has actually taken part in the activity being reviewed.
(2) The provider shall state in the application whether, and by what means, it ensures that published reviews are from users who have actually used the service.
(3) The provider may remove reviews that contravene paragraph 1 or Section 10(1), and shall notify the user of this, stating the reasons.
Section 13: Order of search results
The order in which activities are displayed in search results and overviews is determined by the main parameters disclosed in the application. The order is not influenced in return for direct payment.
Section 14: Liability
(1) The provider shall be liable without limitation for damage resulting from injury to life, limb or health arising from an intentional or negligent breach of duty, as well as for any other damage arising from wilful misconduct or gross negligence.
(2) In the event of a breach due to slight negligence of an obligation whose fulfilment is essential to achieving the purpose of the contract, the provider’s liability shall be limited to the foreseeable damage typical for this type of contract.
(3) In all other respects, the provider’s liability is excluded. Liability under the Product Liability Act and arising from any guarantee given remains unaffected.
(4) The provider shall not be liable for any breach of duty on the part of the organiser, in particular for the non-performance, delayed performance or defective performance of the activity, nor for any personal injury or damage to property arising in the course of the activity.
(5) The provider shall only be liable for information posted by the organiser regarding its activities if the provider was aware that the information was incorrect and failed to take immediate action.
Section 15: Notification procedures, justification of measures, appeals
(1) Users and other individuals may report unlawful content on the platform to the provider via the reporting function provided within the application or by writing to the contact address specified in Section 1(1).
(2) The provider shall acknowledge receipt of a report, decide on it promptly, carefully and in a non-arbitrary manner, and notify the complainant of its decision, together with the reasons for it and the available remedies.
(3) If the provider restricts the visibility of content, terminates the provision of a service or suspends a user account, it shall inform the user of the measure taken, the underlying facts and circumstances, the legal basis and the available remedies.
(4) The user may lodge a complaint against decisions taken pursuant to paragraph 3 within six months of receiving notification, via the provider’s internal complaints procedure. The right to bring the matter before a court remains unaffected.
Section 16: Suspension and Termination of the User Agreement
(1) The provider may restrict, suspend or terminate the user’s access to the platform, in whole or in part, if
- the user commits a serious breach of Section 10 or repeatedly breaches it despite being asked not to,
- there are specific grounds for suspecting a criminal offence, in particular payment fraud,
- the measure is necessary to avert a threat to the safety of the platform or to other persons,
- where required by law or by an order from a public authority or a court.
(2) The provider shall choose the least onerous appropriate measure and, in so far as this is possible under the circumstances and legally permissible, shall first request the user to remedy the situation giving rise to the complaint. Section 15(3) and (4) shall apply mutatis mutandis.
(3) The user may terminate the user agreement at any time without notice by deleting their user account. The provider may give notice of termination of the user agreement with fourteen days’ notice. The right to terminate the agreement for good cause in accordance with Section 314 of the German Civil Code (BGB) remains unaffected for both parties.
(4) Booking contracts that have already been concluded remain unaffected by the termination of the user agreement. The user may back up their data using the application’s export function before it is deleted.
Section 17: Changes to the Platform and these Terms of Use
(1) The Provider may modify the platform insofar as such modification is necessary to adapt the platform to a changed technical environment, an increased number of users, a changed legal situation or significant operational requirements, and insofar as this does not result in any additional costs for the user.
(2) If a change referred to in paragraph 1 significantly impairs the user’s access to the platform or its usability, the provider shall inform the user of this in a clear and comprehensible manner at least thirty days before the change takes effect. In such a case, the user may terminate the user agreement without notice within thirty days of receiving the notification or from the date on which the change takes effect.
(3) The Provider may amend these Terms of Use to the extent that this is necessary to bring them into line with changes in the legal situation, changes in case law, regulatory requirements or changes to the range of services offered, provided that the User is not unreasonably disadvantaged as a result. The Provider shall give notice of the amendment in writing at least thirty days before it takes effect and shall draw attention to the amendment, the right to object and the consequences of such an objection.
(4) If the user does not object before the amendment comes into effect, the amendment shall be deemed to have been accepted. If the user objects, the provider is entitled to terminate the user agreement with effect from the date on which the amendment was due to come into effect. Booking contracts that have already been concluded remain unaffected.
Section 18 Data Protection
The provider processes personal data in accordance with the separate privacy policy. This does not form part of these Terms of Use. Where processing is based on consent, such consent is obtained separately and outside the scope of these Terms of Use, and may be withdrawn at any time.
Section 19: Choice of law, jurisdiction, dispute resolution, final provisions
(1) German law shall apply. If the user is a consumer, the mandatory consumer protection provisions of the country in which they have their habitual residence shall remain unaffected.
(2) The statutory provisions shall apply in respect of the place of jurisdiction.
(3) The provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
(4) Notices given in connection with this user agreement may be provided in writing, in particular via the application or by email.
(5) Should any provision of these Terms of Use be invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the relevant statutory provisions.
